SAFETY AND RELEASE FROM LIABILITY:

BY ADDING YOUR INITIALS TO THE ITEMS BELOW YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOU or YOUR CHILD’S PRESENCE AND/OR PARTICIPATION IN EQUINE ACTIVITIES AT PAPER BIRCH FARM, INCLUDING INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE NEGLIGENCE OF PAPER BIRCH FARM. A. Helmets and Safety Gear: I understand that Paper Birch Farm requires all riders to wear an SEI approved riding helmet. I also understand that it is the recommendation of Paper Birch Farm that I research and utilize other safety gear appropriate to my level of experience while on a horse. I also accept full responsibility for any accident or injury to myself, family members, guests, and or others if I or they do not follow these rules and recommendations regarding the use of riding helmets or other appropriate safety gear. B. Horses are Inherently Dangerous: I understand that engaging in equine activities is an inherently dangerous activity, and that, by doing so, I expose myself to dangers both known and unknown. Horses are large, unpredictable animals which may be dangerous no matter how much training they have, no matter what level of experience I or my family members, guests, and or others I invite to ride my horse have, no matter what the situation. I agree and understand that Paper Birch Farm cannot control the horses it boards or the horses I ride, and that I shall release and hold harmless Paper Birch Farm from any injury arising out of or related to equine activities at Paper Birch Farm’s facilities. C. Responsibility for my own Conduct and That of the Horse I Ride/Handle:: I accept full responsibility for my own conduct and that of the horse I ride/handle while engaging in equestrian activities at Paper Birch Farm. I understand that I will ride and handle horse(s), and will conduct myself, at my own risk while I am on Paper Birch Farm’s property. Initials below indicate understanding and agreement: *

D. RELEASE AND WAIVER OF LIABILITY, AND ASSUMPTION OF RISK: I take full responsibility for myself, my family members, and for any guest that I may bring onto the Paper Birch Farm property and agree I will not hold Paper Birch Farm, it’s owners, agents, or employees responsible or liable for any accident or injury to myself, my family members, my guest, or my agents, or any damage to the property of myself, my family members, my guests or my agents. E. Death or Injury to Horse: Should I someday or currently ride and/or board my own horse on the premises, Paper Birch Farm, its owners, trainers, agents, or employees shall not be held responsible or liable for injury or death to my horse absent gross negligence on their part Initials below indicate understanding and agreement.*

F. Hold Harmless, Defend,and Indemnify: As a Participant in Equine Activities and/or the Parent/Guardian of Participant in Equine Activities (if Participant is under 18 years of age), I agree to defend, indemnify, save and hold harmless Paper Birch Farm and its principals, agents, and affiliates from and against any loss, liability, damage, attorney’s fees, or costs that they may incur arising out of or in any way connected with Participant’s participation in Equine Activities, use of Paper Birch Farm’s stable, presence at Paper Birch Farm’s facilities, Horse’s conduct, or Paper Birch Farm’s agents’ actions, breaches, failures, or omissions in performing or furthering this Agreement. G. Costs, Attorneys’ Fees, and Expense: In any legal actions brought in connection with this Agreement, arising out of this Agreement, or arising out of any activity of Horse, Participant in Equine Activities and Parent/Guardian of Participant in Equine Activities (if Participant is under 18 years of age), or their quests or agents, the prevailing party will be entitled to prompt payment of expenses from the other party following final adjudication in favor of the prevailing party. For the purpose of this Section, “expenses” will include the following costs reasonably incurred by the prevailing party: attorneys’ fees, retainers, court costs, transcript costs, fees of experts, witness fees, travel expenses, duplicating or copying costs, printing and binding costs, telephone charges, postage, delivery service fees, canceled lessons, and all other disbursements Initials below indicate understanding and agreement: *

ENTIRE AGREEMENT: This Agreement contains the entire agreement of the parties with respect to boarding horses, participation in Equine Activities, and safety and liability releases. Any modifications or additions must be in writing and signed by all parties to the Agreement. No oral modifications will be considered part of the Agreement unless reduced to writing and signed by all parties.

COMPREHENSION: Each party hereby affirms and acknowledges that they have been given the opportunity to obtain independent legal review by an attorney of their choosing if so desired, that they have read this entire Agreement, that it is in plain language, and that they fully understand and appreciate the meaning of each of its terms.

GOVERNING LAW AND VENUE: This Agreement shall be governed by the laws of Alaska. Venue for resolution of disputes shall be proper in the municipality of Anchorage, Alaska.

BARN RULES:

Please read and review these rules yourself and with any minor visitors or participants in your care.

1. Be aware and move carefully.
Horses can bite, kick, step on, or cause harm to people, themselves, or others by accident, particularly when startled.

2. Do not run, yell, or make sudden movements.

3. Clean up after yourself & do a little extra when you can.
Please try to leave the barn, arena, porta-potty, etc. as clean or even cleaner than you found them.

4. Ask permission before:
Petting or feeding horses, climbing the ladder, entering stalls/paddocks/fields/arenas, or interacting with horses or equipment.

5. Treat horses and humans with respect and kindness.

6. Wear a helmet and heeled boots when riding.

7. Learn all you can & ask questions if you have them.

8. Read all signs around the barn to learn any additional rules and procedures. *And let us know if you have any questions about these too.
